Lawyers at firm, Holding Redlich have recommended companies consider Chain of Responsibility (CoR) liability insurance against unintended breaches.
Under the Chain of Responsibility, anyone involved in the supply chain whether consignor, consignee, dispatcher, packers, loaders, drivers etc. can be liable for breaches of the Heavy Vehicle National Law (HVNL).
The attorneys believe companies should protect themselves against unintentional breaches by way of insurance.
Companies should keep in mind that penalties imposed for CoR breaches are based on the severity of the offence and can be enforced as administrative or court penalties, with heavy fines imposed which could have a huge impact on a business’ financial stability.
In addition to fines, companies can have their fleets grounded which could further negatively impact business.
